In general, psychologists are expected to be able to
participate in the settlement if they provided out-of-network services to Aetna subscribers from 2003
to August 2013. As with prior class action lawsuit
settlements, APAPO will provide guidance in its
PracticeUpdate e-newsletter to help psychologists
verify their eligibility to participate in the settlement
and file claims.
Helping practitioners understand and use
the new psychotherapy billing codes
Beginning in September 2012 and continuing
into 2013, the APA Practice Organization
mounted an extensive educational campaign to
help familiarize practicing psychologists with
new procedure codes for psychotherapy. The
codes, which took effect on January 1, 2013,
must be used when billing clients and filing
health insurance claims for all third-party payers,
including Medicare, Medicaid and private health
The Fall 2012 issue of APAPO’s award-winning

Helping members comply with the HIPAA
By Sept. 23, 2013, psychologists covered by the
Health Insurance Portability and Accountability
Act (HIPAA) were required to implement changes
required by the HIPAA Final Rule from the U.S.
Department of Health and Human Services.

psychologists concern enforcement and penalties,
breach notification, notice of privacy practices

During the summer of 2013, the APA Practice
Organization disseminated to APAPO members a
resource called The HIPAA Final Rule: What you
need to do now. This resource includes inserts
needed to update existing HIPAA forms, such as a
psychologist’s notice of privacy practices. Further,
APAPO updated and circulated its Privacy Rule
